An initial appearance was scheduled for Nov. 28 for an Elkhorn man charged with hitting a truck and a guardrail while under the influence of drugs in the Town of Geneva.
Michael D. Schmuck, 36, was charged Nov. 5 in Walworth County Circuit Court with second-degree recklessly endangering safety, misdemeanor bail jumping and possession of drug paraphernalia, all as a repeater.
According to the criminal complaint, other drivers saw a car Schmuck was driving on Highway 12 in the Town of Geneva on April 19 travel from the right shoulder to the left lane multiple times, hit a truck and then hit a guard rail two to three times before coming to a stop against the guardrail. One witness saw Schmuck with a syringe in his hand and slumped over the steering wheel, the complaint states.
When officers arrived, Schmuck was unresponsive, and police administered four doses of Narcan before Schmuck revived. A used syringe and a spoon that contained burnt residue were found in the car, according to the complaint.
Schmuck did not remember being in an accident and was taken to Aurora Lakeland Medical Center where he said he’d consumed Percocet by trying to cook and inject it, the complaint states. The residue on the spoon tested positive for fentanyl, and fentanyl was detected in Schmuck’s blood, the complaint states.
Schmuck was under bond conditions at the time on a Kenosha County case of possession of drug paraphernalia and was convicted of burglary in Walworth County in 2012.
