In a special City of Elkhorn Committee of the Whole meeting June 22, councilmen voted 3-2 against granting a convicted sex offender an exemption to the city’s sex offender residency restriction ordinance.
Aldermen Greg Huss, Michael Kluck and Tom Myrin voted against granting Hoffman an exemption, while aldermen Scott McClory and Hoss Rehberg cast votes in favor.
Attorney Frank Lettenberger represented Michael Hoffman Monday night, a convicted sex offender who was appealing the city’s residency restriction to live with his mother and stepfather at 408 Amparo St., in Elkhorn.
Hoffman, 45, was convicted of sexual assault shortly after graduating high school for two 1989 incidents and Hoffman said there were no allegations he had used force with any of the three underage girls he was involved with. Hoffman was later found guilty of misdemeanor sex with a 17-year-old girl in 2006 and not guilty of three felony counts of second-degree sexual assault with an unconscious victim.
