A Woodstock, Ill. man has been arrested and charged with OWI-homicide following a one-car crash June 14 in the Town of Walworth. The crash left a 22-year-old Fontana man, dead, according to the Walworth County Sheriff’s Office.

Daniel P. Consolo, 24, was charged June 25 in Walworth County Circuit Court with homicide by intoxicated use of a vehicle. A preliminary hearing is scheduled for July 31.

Kevin D. Green, 22, of Wonder Lake, Ill., and Fontana was killed in the crash.

According to the sheriff’s office, deputies and officers from the Village of Walworth and the Fontana Police departments responded shortly after 7:40 a.m. June 14 to a report of an auto accident on Cobblestone Road, west of the Linn-Walworth Town Line Road.

Upon arrival, sheriff’s deputies saw a Jeep that had struck a tree and several bottles of beer on the scene.

Consolo, who was found lying near the driver’s side door of the Jeep, was taken to Mercy Walworth Medical Center for a broken leg. Consolo smelled like alcohol, appeared to be intoxicated and refused a blood draw. Police obtained a search warrant for Consolo’s blood, which was drawn at 10:37 and 11:57 a.m.

Besides Consolo, three other passengers were in the vehicle at the time of the crash. They were identified as Green, 22; Adam M. Szudarski, 21, and Ryan A. Szudarski, 21, of Wonder Lake, Ill.

Green was taken by ambulance to Aurora Lakeland Medical Center in Elkhorn, and then transferred by Flight for Life to a Milwaukee-area hospital where he later succumb to his injuries, according to the release.

Adam Szudarski was admitted to a McHenry County-area hospital with serious injuries. His condition has not yet been updated.

Ryan Szudarski said he, his brother, Consolo and Green were drinking in Illinois beginning at around 7 p.m. June 14. At about 5 or 6 a.m., Szudarski said, they ran out of alcohol and drove toward a residence in Fontana. He said they bought more alcohol and continued to drink. Szudarski said Consolo was driving through fields, doing donuts in lawns and drinking while he was driving the Jeep. He said at the time of the crash, Consolo went straight where the road turned and struck a tree.

Consolo is being held in a Wisconsin hospital with severe injuries. Once released from the hospital, Consolo will appear for an initial bond setting, the release noted.
