Illinois man charged in fatal crash in Walworth

A preliminary hearing is scheduled for July 31 for an Illinois man charged in con-nection with a drunken driv-ing crash that killed a Fon-tana man who was a passen-ger in the vehicle.

Daniel P. Consolo, 24, of Woodstock, Ill., was charged June 25 in Walworth County Circuit Court with homicide by intoxicated use of a vehi-cle.

According to the criminal complaint:

Police were called to a one-vehicle crash on Cobble-stone Road in the Town of Walworth at about 7:45 a.m. June 15. Upon arrival, sher-iff’s deputies saw a Jeep that had struck a tree and several bottles of beer on the scene. A resident heard the crash and went to the scene to help. She saw two men get out the back doors of the Jeep and flee the scene. She helped remove the front passenger, later identified as Kevin Green, from the Jeep. Green, 22, of Fontana, was treated for injuries on the scene but died later at Froedtert Hospi-tal in Wauwatosa.

Consolo, who was found lying near the driver’s side door of the Jeep, was taken to Mercy Walworth Medical Center for a broken leg. Con-solo smelled like alcohol, appeared to be intoxicated and refused a blood draw. Police obtained a search war-rant for Consolo’s blood, which was drawn at 10:37 and 11:57 a.m.

A sheriff’s deputy spoke June 15 to Adam Szudarski, 21, of Wonder Lake, Ill., who was being treated for injuries at Contegra Hospital in McHenry, Ill. Szudarski ad-mitted he and his twin broth-er, Ryan Szudarski, were the rear passengers in the Jeep when it crashed. He said he and Ryan Szudarski left the vehicle when it crashed and a friend picked them up.

Szudarski said he, his brother, Consolo and Green were drinking in Illinois be-ginning at around 7 p.m. June 14. At about 5 or 6 a.m., Szudarski said, they ran out of alcohol and drove toward a residence in Fontana. He said they bought more alcohol and continued to drink. Szudarski said Consolo was driving through fields, doing donuts in lawns and drinking while he was driving the Jeep. He said at the time of the crash, Consolo went straight where the road turned and struck a tree.
