New Beginnings APFV files lawsuit

It’s in response to Elkhorn Council’s denial of permit

New Beginnings Association for the Prevention of Family Violence has filed a civil lawsuit in Walworth County Circuit Court against City of Elkhorn officials.

New Beginnings is attempting to open Walworth County’s first domestic shelter at 20 N. Church St. in downtown Elkhorn, across from the Walworth County Government Center and the Elkhorn Police Department. According to City documents, the building, formerly an Aurora Health clinic, has been donated to New Beginnings.

The suit was filed on Oct. 23 to appeal the adverse action of the Council in denying the conditional use permit application, according to Raymond Dall’Osto, the attorney representing New Beginnings.

Dall’Osto is with the firm of Gimbel, Reilly, Guerin & Brown LLP of Milwaukee.

“Once the record is filed, New Beginnings will supplement its argument and reasons,” Dall‘Osto said.

He said the best case scenario is that the judge will reverse the decision and the permit will be granted to New Beginnings.
