Man charged in alleged baseball-bat assault

A 48-year-old Mukwonago man is charged with assault after he allegedly struck a 41-year-old man in the head with a baseball bat.

Marcus Sevilla was charged April 10 in Walworth County Circuit Court with aggravated batter and first-degree reckless injury, both with the use of a dangerous weapon. Sevilla was also charged with disorderly conduct, with domestic abuse assessments.

According to the criminal complaint, police were called to a residence on Highway J in the Town of East Troy April 3 for a report of an injured person.

When police arrived, they found the victim lying at the end of the home’s driveway with a severe head injury. The victim’s head was “cradled” by a woman who was yelling at Sevilla, according to the complaint.

The victim was transported to Froedtert Hospital by helicopter, the complaint states. A portion of the victim’s skull needed to be removed at the hospital to relieve brain swelling.

According to the complaint, the woman said she was married to Sevilla but had been separated for about two weeks after he had been “physically abusive to her.” She told police she went to the residence to get a birthday present that her mother had left her and she had asked the victim to accompany her.

She told police she talked to her son and was able to get the present out of her son’s vehicle, according to the complaint. She said Sevilla come out of the home and began arguing “face-to-face” with the victim. After a while, the argument ended and Sevilla went back into the home.

The woman told police that when she was walking back to her vehicle, Sevilla came out of the home again and had a baseball bat, according to the complaint. The argument between the two men resumed and Sevilla shoved his wife to the ground, the complaint states. The victim told Sevilla not to put his hands on her again.

According to the complaint, Sevilla then shoved the victim to the ground and repeatedly struck him in the head with the baseball bat.

Sevilla’s wife said she called 911 and Sevilla went back into the home while she held the victim’s head in her lap, waiting for help.

If convicted on all charges, Sevilla is facing up to 50 years in prison and slightly more than $150,000 in fines.

Sevilla was bound over for trial April 15 and is next scheduled to appear in Walworth County Court for a status conference May 28.
