Man charged with raping girlfriend set to appear

A status conference is scheduled for Aug. 3 for a Madison man charged with raping his girlfriend at gunpoint in Whitewater.

Richard D. Oberst, 33, was charged April 11 in Walworth County Circuit Court with two counts of first-degree sexual assault with lifetime supervision of serious sex offenders; possession of a firearm by a felon; false imprisonment with the use of a dangerous weapon; and two counts of operating a motor vehicle without the owner’s consent. A jury trial is scheduled for October in his case.

According to the criminal complaint, a woman who lived with Oberst in Whitewater told police April 8 that on March 27, she had told Oberst, who is addicted to heroin, that their relationship was over. The woman said Oberst said words to the effect of “then my life is over,” and the woman then began recording their conversation.

The recording captured Oberst subsequently raping the woman, and he could be heard saying he was going to “f—“ her one more time before he killed himself, according to the complaint. The woman said Oberst had a rope, tape, a sock and a loaded revolver during the assault, according to the complaint.

On the recording, the woman could be heard begging Oberst to stop, telling him she was afraid and asking him to turn the gun away from her, according to the complaint. The woman said Oberst sat on her chest and pinned her hands by her sides with his knees so that she could not hold her pants on, according to the complaint. She said he had sex with her without her consent and had the gun very close to her face during the assault, according to the complaint.

The woman said Oberst also took her van without her permission on March 27 and April 8 and used it to go get heroin despite telling her he was going to a Narcotics Anonymous meeting on April 8, according to the complaint.

Each of the first-degree sexual assault offenses carries a life sentence if Oberst is convicted. Oberst has served time in prison for possession of narcotic drugs in Waukesha County.
