Walworth man charged with repeated sexual assault of a child

A 35-year-old Walworth man has been charged with sexually assaulting a now 10-year-old girl on multiple occasions in 2014.

Jose A. Vergara-Posada was charged April 14 with one count of first degree repeated sexual assault of a child younger than 13 and one count of exposing genitals to a child.

Vergara-Posada was scheduled to appear in court at 1:15 p.m. on Wednesday for an adjourned initial appearance.

According to the criminal complaint, Officer Jessie Lewin and Lt. Andrew Long of the Village of Walworth Police Department met with Walworth Grade School Counselor Lee Knoble-Janney on April 7, who notified them a 10-year-old female student put a note in a mailbox used by students to share confidential notes with counselors and teachers. The complaint states that Knoble-Janney told police the victim wrote in the note she needed to speak with a counselor about body safety and asked that her friend be with her.

Knoble-Janney told police the girl said her 8-year-old cousin, was also present during the incident, according to the complaint, which she said occurred in the summertime at their babysitter’s house, later identified as Balbina Ariana Flores-Flores, Vergara-Posada’s wife.

According to the complaint, the 10-year-old girl told counselors she and her cousin were taken into the bedroom by Vergara-Posada at the babysitter’s house and he allegedly would lock the door and tell them to sit on the bed. The girl said the man allegedly put a pillow over her face and pushed her back onto the bed, the complaint states.

The 10-year-old told counselors she and her cousin both had dresses on and Vergara-Posada pulled her dress over her ahead and touched her private parts with his hand, according to the complaint.

The complaint said the girl told counselors when Flores-Flores knocked on the door, Vergara-Posada allegedly told the girls to put their dresses down and pretend to look for a DVD so he would not get in trouble. According to the complaint, the girl said he threatened her and told her if she told anyone, he would kill her family.

The complaint states the girl told counselors this happened four or five times over the course of the summer and that she and her cousin wore jeans after the first time because they were afraid what might happen when they wore the dresses. Vergara-Posada would allegedly make the girls go into the bedroom, lock the door and pull down their pants and underwear and would allegedly touch her privates with his hand while holding her down by her wrist.

According to the complaint, the girl’s 8-year-old cousin told the counselor while she did not remember much from when she was babysat by Flores-Flores, she remembered that everyday the man allegedly wanted to take her into the bedroom to “play doctor.” The complaint states the girl said she remembers another, slightly younger girl being in the bedroom as well, possibly 4 or 5 years old.
